1. Acceptance of Terms

By accessing or using HiTouch ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and HiTouch.

2. Description of Service

HiTouch is an AI-powered real estate CRM platform that provides contact management, lead scoring, data enrichment, workflow automation, email and SMS communication tools, property research, and AI-assisted analytics. The Platform is available by invitation only.

3. Account & Access

  • Access to HiTouch requires an invitation from an authorized administrator.
  • You must sign in using a valid Google or Microsoft account.
  • You are responsible for maintaining the security of your account and any activity that occurs under it.
  • You must not share your account access with unauthorized individuals.
  • We reserve the right to suspend or terminate accounts at our discretion.

4. Acceptable Use

You agree to use HiTouch only for lawful purposes. You must not:

  • Use the Platform to send unsolicited bulk communications (spam)
  • Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or other applicable communications laws
  • Upload or store data you do not have the right to use
  • Attempt to gain unauthorized access to the Platform or its systems
  • Use the Platform to harass, threaten, or harm any person
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated scripts or bots to access the Platform beyond its intended API usage
  • Resell, sublicense, or redistribute access to the Platform

5. Data & Content

Your Data

You retain ownership of all data you upload or enter into HiTouch, including contact information, property data, notes, and communications. You grant us a limited license to process, store, and display this data as necessary to provide the service.

Third-Party Data

Data obtained through enrichment services (Enformion, ATTOM, county records) is subject to the terms and conditions of those respective providers. You agree to use enrichment data only for legitimate business purposes and in compliance with applicable laws.

AI-Generated Content

HiTouch uses AI (OpenAI GPT-4) to generate lead scores, personas, scripts, summaries, and recommendations. AI-generated content is provided as-is and should be reviewed before use. We do not guarantee the accuracy of AI outputs.

6. Communications Compliance

When using HiTouch to send emails or SMS messages, you are solely responsible for compliance with all applicable laws, including but not limited to:

  • The CAN-SPAM Act (email communications)
  • The Telephone Consumer Protection Act (SMS/phone communications)
  • State-specific Do Not Call regulations
  • Real estate industry regulations and licensing requirements

You must honor opt-out requests and Do Not Call preferences. HiTouch provides tools to help manage compliance (e.g., doNotCall flags, unsubscribe handling) but compliance is ultimately your responsibility.

7. Intellectual Property

The HiTouch platform, including its software, design, logos, and documentation, is the intellectual property of HiTouch and is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Platform without our written consent.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Platform. We may perform scheduled maintenance, updates, or experience downtime due to circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, HiTouch and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless HiTouch, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to HiTouch at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. You may request export of your data prior to account deletion.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of HiTouch after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Cuyahoga County, Ohio.
